These Terms and Conditions govern the use of private transportation services offered under the commercial brands Transfers Shark (https://www.transfersshark.com) and Cancun Private Transfers (https://www.cancunprivatetransfers.com), including browsing, booking, payment, and customer support interactions through the respective websites and official communication channels (collectively, the “Websites”).

Both brands are operated by ACE Mimetic Tech Company S.A. de C.V., a company duly incorporated under the laws of the United Mexican States (“we”, “us”, or the “Company”).

By accessing either Website, requesting information, or completing a reservation under any of the Company’s brands, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions (“Terms”).
If you do not agree with these Terms, you must refrain from using the Websites and Services.


Scope of These Terms

These Terms apply to all private ground transportation, airport transfers, and related services offered under the Transfers Shark and Cancun Private Transfers brands in the Riviera Maya region, including but not limited to Cancun, Playa del Carmen, Puerto Morelos, Akumal, Tulum, and surrounding areas, as well as any other destinations expressly listed on the applicable Website.

These Terms govern your interactions with the Websites, the booking and payment process, cancellations, modifications, service delivery, passenger obligations, waiting times, no-show policies, limitations of liability, and all other operational and legal aspects of the Services.


Definitions and Interpretation

  • Service Brand: Refers to the commercial brand under which the Service is marketed and booked, namely Transfers Shark or Cancun Private Transfers.

  • Company: ACE Mimetic Tech Company S.A. de C.V., the legal entity responsible for operating the Services, regardless of the Service Brand used.

  • Client / You / Passenger: The individual or legal entity placing a reservation, as well as all passengers traveling under that reservation.

  • Service: Any private transfer, airport transfer, point-to-point transportation, or related ground transportation service sold, confirmed, or performed under either Service Brand.

  • Booking / Reservation: A request for Services submitted via one of the Websites or official Company channels and confirmed by the Company.

  • Local Time: The local time at the pickup location (Riviera Maya / Cancun time).

  • Same-Day Booking: A reservation placed for Services occurring on the same calendar day.

Headings are provided for convenience only and do not affect interpretation.


Eligibility and Use of the Websites

The Websites are intended for use by adults capable of entering into legally binding agreements. Parents or legal guardians booking on behalf of minors assume full responsibility for the accuracy of the information provided and for the conduct, safety, and supervision of minors during the Service.

Use of the Websites is permitted solely for legitimate reservation purposes. Any speculative, false, abusive, or fraudulent booking activity—under either Service Brand—is strictly prohibited and may result in cancellation without refund.


Booking and Confirmation

A booking is considered completed once all required information has been submitted and a confirmation has been issued through the applicable Website or via an official Company email address.

The Company reserves the right to accept, decline, or cancel a booking at its reasonable discretion, including for reasons of availability, security concerns, operational limitations, or non-compliance with these Terms.

You are responsible for providing accurate and complete booking details, including full names, contact information, flight numbers, arrival or departure times, hotel or pickup location, passenger count, luggage details, and any special requests. Any changes must be communicated promptly through official channels.


Accuracy of Information and Client Responsibility

Services are performed strictly based on the information provided by you at the time of booking.

If incorrect, incomplete, or outdated information (including flight number, date, terminal, hotel, or pickup location) results in a delayed, failed, or misdirected service, the Service may be deemed rendered as contracted, and no refund will be due.

For group travel involving multiple flights, you must provide the details of the last flight scheduled to arrive to ensure proper coordination.


Pricing, Taxes, and Fees

Prices are displayed on the applicable Website or communicated through official Company channels. Unless expressly stated otherwise, prices do not include bank charges, currency conversion fees, or third-party transaction fees imposed by your financial institution.

The Company reserves the right to update pricing due to changes in fuel costs, government fees, tolls, taxes, or operational factors. The price confirmed at the time of booking will apply to your reservation.


Payments and Accepted Currencies

We accept Stripe, PayPal, and cash on arrival, subject to availability and booking conditions.

Our principal currency is USD, and payments may also be accepted in CAD, MXN, EUR, and COP. Exchange rates and related fees are determined exclusively by your issuing bank, card network, or PayPal and are beyond the Company’s control.

Same-day bookings require full payment at the time of booking. Advance reservations must be paid within the timeframe specified at checkout, failing which the reservation may be automatically canceled.


Payment Security and Fraud Prevention

The Company does not store or process card data. All electronic payments are handled securely by Stripe or PayPal under their respective security and privacy policies.

We reserve the right to cancel, suspend, or place a booking on hold if fraud, unauthorized use, chargeback abuse, or non-compliance with these Terms is suspected. You agree to cooperate with reasonable verification requests.


Vouchers, Promotions, and Credits

Promotional codes, discounts, or credits are subject to the specific terms communicated at issuance, including validity periods, route eligibility, non-transferability, and non-refundable nature. The Company reserves the right to modify or withdraw promotions at any time, in accordance with applicable law.


Modifications and Service Changes

Requests for modifications (date, time, pickup location, route, vehicle type, or passenger details) must be submitted before 18:00 (local time) on the day prior to the scheduled Service.

Requests received after this deadline are subject to availability and may incur additional charges. The Company will make reasonable efforts to accommodate changes but does not guarantee availability, especially during peak travel periods.


Cancellations and Refunds

Standard cancellations:

  • Cancellations made 24 hours or more prior to the scheduled Service are subject to a 5% handling fee, which covers non-refundable payment gateway and administrative costs.

  • Cancellations made within 24 hours of the scheduled Service are non-refundable.

Refund processing times:

  • Stripe (card): typically 3–30 business days, depending on issuing bank.

  • PayPal: up to 5 business days.

The Company is not responsible for delays or fees imposed by banks or payment platforms.

All cancellation fees and conditions are disclosed prior to payment and form an integral part of the contractual terms accepted at checkout.

 


No-Show Policy

Each booking includes a 15-minute grace period from the scheduled pickup time.

Failure to appear at the designated meeting point within this period, or leaving the pickup location without notifying the Company, will result in the reservation being marked as a No Show, with no refund issued.

Proof of Service Attempt
Driver presence and service attempt may be evidenced by GPS tracking logs, time-stamped photographs, dispatch records, vehicle telematics, call logs, or written communications. Such records shall be deemed sufficient and conclusive proof that the Company attempted to render the Service as contracted.


Flight Delays, Missed Flights, and Re-Routing

We monitor arrivals based on the flight number provided. If a flight is missed or significantly delayed, you must notify us immediately.

Rescheduling is subject to vehicle availability and may be treated as a same-day modification with applicable charges. The Company is not responsible for airline decisions, missed connections, or cancellations and does not provide refunds in such cases.

Landing Time Disclaimer
Flight landing time does not constitute pickup time. Pickup is based solely on the scheduled time confirmed in the reservation or subsequently agreed in writing through official Company channels.


Arrival Instructions and Meeting Point

At Cancun International Airport, passengers are typically met in front of the Welcome Bars or another meeting point specified in the booking confirmation.

Passengers should allow approximately 40 minutes after landing for immigration and baggage claim. Delays beyond this timeframe must be communicated promptly.


Departure Pickup and Early Arrivals

Departure pickup times are calculated to include travel time plus two (2) hours for airline check-in. Requests for earlier departures are subject to availability. Responsibility for arriving excessively early rests solely with the Client.


Waiting Time and Late Policy

Additional waiting time beyond the grace period may be charged in 15-minute increments at the rate communicated by customer support. If extended waiting compromises subsequent services, the Company may terminate the wait and mark the booking as a No Show.


Terminal Changes and Inter-Terminal Transfers

USD $5 fee applies when pickup and drop-off occur at different airport terminals. No additional charge applies when only the drop-off terminal differs.


Group Travel and Multiple Flights

For groups arriving on multiple flights, details of the last arriving flight must be provided. Uncoordinated arrivals may result in additional charges or separate transfers.


Luggage and Personal Items

Passengers are responsible for their luggage and personal belongings. Oversized or excess baggage must be disclosed in advance and may incur additional charges. The Company is not liable for lost or damaged items unless caused by gross negligence or willful misconduct.


Car Seats, Accessibility, and Special Requests

Car seats and special accommodations are provided subject to availability and may carry additional fees. Availability is not guaranteed. If a requested item is unavailable and the Client elects not to proceed, cancellation rules apply.


Identification and Conduct

Passengers may be required to present valid identification prior to boarding. Failure to do so may result in service denial without refund.

Abusive, unsafe, or illegal behavior may result in service termination without refund and, where appropriate, involvement of authorities.


Service Limitations and Adjustments

Routes, vehicles, and pickup points may be adjusted due to traffic, road closures, or operational constraints. Specific vehicle models are not guaranteed; a comparable or upgraded category may be provided.

Vehicle Representation
Vehicle images, descriptions, and model references displayed on the Websites are illustrative only and do not constitute a guarantee of a specific unit. The Company reserves the right to provide a comparable or upgraded vehicle within the same category.


Third-Party Services

Payment platforms and third-party providers operate under their own terms. The Company is not responsible for their acts or omissions beyond the scope of the confirmed Service.


Data Protection and Privacy

Personal data is processed in accordance with the Company’s Privacy Policy. Payment data is processed by third-party platforms; the Company does not store card details.


Communications and Official Channels

Only communications through official Websites, official phone numbers, or authorized @transfersshark.com and @cancunprivatetransfers.com email domains are recognized. Messaging apps such as WhatsApp are provided as a convenience only and do not replace official confirmation channels.

Messaging Applications Disclaimer
Messaging applications, including but not limited to WhatsApp, are provided strictly as a convenience and do not replace official confirmations. Screenshots, forwarded messages, edited messages, or partial conversation records shall not override booking confirmations, invoices, or written notices issued by the Company through official channels.


Force Majeure

The Company shall not be liable for failures or delays caused by events beyond its reasonable control, including natural disasters, pandemics, government actions, strikes, extreme weather, or civil unrest.


Liability and Disclaimers

To the maximum extent permitted by law, the Company’s total liability is limited to the amount paid for the affected Service. Nothing herein limits liability for death or personal injury caused by gross negligence or willful misconduct where prohibited by law.

Excluded Damages
Loss of enjoyment, loss of vacation value, emotional distress, inconvenience, or subjective dissatisfaction shall not be considered compensable damages.


Insurance

Clients are responsible for obtaining appropriate travel insurance. The Company’s insurance covers only legally required operational risks.


Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. Any dispute shall be submitted to the competent courts of Quintana Roo, Mexico.


Language

In the event of translation, the English version shall prevail.


Changes to These Terms

Updates take effect upon publication. Existing, fully paid reservations are governed by the version in force at the time of booking unless changes are beneficial to the Client.


Entire Agreement

These Terms, the booking confirmation, and the Privacy Policy constitute the entire agreement between the Client and the Company.

Brand Disclaimer
The Service Brand is a commercial designation only and does not constitute a separate legal entity. All Services are contracted with and performed by ACE Mimetic Tech Company S.A. de C.V., which remains the sole responsible party regardless of the Service Brand used.


Customer Acknowledgment

By completing a booking under Transfers Shark or Cancun Private Transfers, you acknowledge full understanding and acceptance of these Terms, including cancellation, refund, and modification policies.

Affirmative Acceptance
Completion of a booking requires affirmative acceptance of these Terms through the booking interface, payment flow, or written confirmation. Such acceptance constitutes legally binding consent, equivalent to a handwritten signature.
