These Terms and Conditions govern the use of Transfers Shark services, including browsing and booking through TransfersShark.com (the “Website”) and any related customer support channels. By accessing the Website or completing a reservation, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). Transfers Shark is operated by ACE Mimetic Tech Company S.A. de C.V. (“we”, “us”, or the “Company”). If you do not agree with these Terms, you must not use the Website or our services.


Scope of These Terms

These Terms apply to all private ground transportation and airport transfer services offered on TransfersShark.com in the Riviera Maya region (including, without limitation, Cancun, Playa del Carmen, and Tulum) and any other locations listed on the Website. They cover your interactions with our Website, the booking process, payment, cancellations, modifications, service delivery, passenger obligations, limitations of liability, and other important provisions.


Definitions and Interpretation

  • Client / You / Passenger: The individual or legal entity placing a reservation, as well as all passengers traveling under the reservation.

  • Service: Any private transfer, airport transfer, or related ground transportation sold or confirmed on the Website.

  • Booking / Reservation: A request for Services submitted via the Website or official channels and confirmed by us.

  • Local Time: The local time at the pickup location (e.g., Cancun / Riviera Maya time).

  • Same-Day Booking: A reservation placed for Services occurring on the same calendar day.
    Headings are for convenience only and do not affect interpretation.


Eligibility and Use of the Website

The Website is intended for adults capable of entering into binding agreements. Parents or legal guardians booking on behalf of minors are fully responsible for the accuracy of information provided and the conduct and safety of minors during the Service. You may use the Website solely for legitimate reservations; speculative, false, or fraudulent bookings are strictly prohibited.


Booking and Confirmation

A booking is completed once you submit all required details and receive a confirmation through the Website or via email from an official Transfers Shark domain. We may decline a booking at our reasonable discretion, including for reasons of availability, security, or compliance.
You must provide accurate and complete information (full names, contact details, flight information, hotel details, passenger count, and any special requests) and promptly update us about any changes.


Accuracy of Information and Client Responsibility

We perform the Service based on the information you provide. If the provided flight number, date, terminal, hotel, or pickup location is inaccurate and leads to a failed or misdirected service, the Service may be considered rendered as contracted and no refund will be due. For group travel, you must provide the details of the last flight to arrive to ensure coordinated pickup.


Pricing, Taxes, and Fees

Prices are displayed on the Website or communicated through our official channels. Unless stated otherwise, prices are exclusive of any bank, conversion, or third-party transaction fees charged by your financial institution. Taxes and surcharges, if any, will be displayed at checkout or communicated prior to payment.
We reserve the right to update prices due to changes in government fees, fuel costs, or material operational factors. The price confirmed at the time of booking will apply to your reservation.


Payments and Accepted Currencies

We accept Stripe, PayPal, and cash on arrival as the available payment methods. Our principal currency is USD, and we may accept payments in CAD, MXN, EUR, and COP. If you pay in a currency other than USD, exchange rates and any related bank or platform fees are determined by your issuing bank, card network, or PayPal, and are beyond our control.
For same-day bookings, full payment is required at the time of booking to secure the Service. For advance reservations, payment and confirmation are required within the time indicated at checkout; otherwise, the reservation may be automatically canceled.


Payment Security and Fraud Prevention

Card data is not stored or processed by us. Payments are handled securely by Stripe and PayPal under their own privacy and security policies. We may cancel or hold a reservation if we suspect fraud, unauthorized use, or non-compliance with these Terms. You agree to cooperate in any verification required to protect both parties from fraudulent activity.


Vouchers, Promotions, and Credits

Any promotional codes, discounts, or credits are subject to specific terms communicated at issuance (e.g., validity dates, eligible routes, non-transferability, non-refundable nature). We may modify or withdraw promotions at any time, in compliance with applicable law.


Modifications and Service Changes

Modification deadline: Requests for changes (date, time, location, route, vehicle options, or passenger details) must be made before 18:00 (local time) on the day prior to the Service.
Requests made after this deadline are subject to availability and may incur additional fees. We will make reasonable efforts to accommodate changes, but availability is not guaranteed—particularly during peak travel periods.


Cancellations and Refunds

Standard cancellations:

  • Cancellations made 24 hours or more prior to the scheduled Service are subject to a 5% handling fee (covers non-refundable payment gateway costs).

  • Cancellations made within 24 hours of the scheduled Service are non-refundable.

Refund processing:

  • Stripe (card): typically 3–30 business days to appear on your statement (dependent on issuing bank).

  • PayPal: up to 5 business days to post.
    We are not responsible for delays or fees imposed by banks or payment platforms.


No-Show Policy

Your booking includes a 15-minute grace period from the scheduled pickup time. If you fail to appear at the designated meeting point within that grace period, the reservation may be marked as a No Show, and no refund will be issued.
If you leave the airport or pickup location without notifying us, this will also be considered a No Show.


Flight Delays, Missed Flights, and Re-routing

We monitor arrivals using the flight number you provided. If your flight is missed, you must notify us immediately to maximize rescheduling options. Rescheduling will depend on vehicle availability and may be treated as a same-day modification, potentially incurring additional charges.
We are not responsible for airline decisions, missed connections, cancellations, or significant delays that prevent the Service from being performed as booked. No refunds are provided in such circumstances; we will, however, make reasonable efforts to reschedule subject to availability.


Arrival Instructions and Meeting Point

At Cancun International Airport, our team typically meets you in front of the Welcome Bars (or the designated meeting point indicated in your confirmation). Please allow approximately 40 minutes after flight arrival for immigration and baggage claim. If the process takes longer than expected, contact us to keep your driver informed.


Departure Pickup and Early Arrivals to the Airport

Departure pickups are calculated to include travel time plus 2 hours for airline documentation and check-in. If you wish to depart earlier than scheduled, we can adjust subject to availability; however, the responsibility for arriving too early lies with you, and the original booking conditions remain in effect.


Waiting Time and Late Policy

Beyond the 15-minute grace period, additional waiting time may be charged in 15-minute increments at the rate communicated by our customer support at the time of your request, subject to vehicle availability. If extended waiting would compromise subsequent services, we may need to terminate the waiting period and mark the booking as a No Show.


Terminal Changes and Inter-Terminal Transfers

If pickup and drop-off occur at different terminals, an additional USD $5 charge applies.
There is no additional charge for drop-offs at different terminals when the pickup terminal remains the same.


Group Travel, Multiple Flights, and Coordination

For groups arriving on multiple flights, you must provide the details of the last flight to arrive to ensure coordinated pickup. If passengers are split across different arrival times or terminals without prior coordination, extra waiting time or additional transfers may be required and billed accordingly.


Luggage and Personal Items

Each passenger is responsible for their luggage and personal items. Standard luggage allowances are indicated at booking; oversized or excess baggage must be disclosed in advance and may incur additional fees or require a larger vehicle. We are not liable for lost, damaged, or stolen items unless caused by our willful misconduct or gross negligence.


Car Seats, Accessibility, and Special Requests

If you request a car seat or any special accommodation, we will use reasonable efforts to provide it. Availability is not guaranteed, and certain requests may carry additional fees. If a requested car seat is unavailable and you decide not to proceed, this will be treated as a cancellation under the applicable rules.
Please inform us in advance of any mobility or accessibility requirements so we can assess feasibility.


Identification and Conduct

For safety and authentication, passengers may be required to present a valid photo ID, driver’s license, or passport prior to boarding. Failure to present identification may result in service denial without refund.
You agree to behave respectfully and in accordance with applicable laws, refrain from damaging the vehicle, and follow reasonable instructions from the driver for safety. We may refuse service, terminate a transfer, or involve authorities in cases of abusive, unsafe, or illegal behavior—without refund.


Service Limitations and Reasonable Adjustments

Routes, vehicles, or pickup points may require reasonable adjustments due to traffic conditions, road closures, security controls, or operational constraints. We will endeavor to provide the most efficient alternative while maintaining service quality. Specific vehicle models are subject to availability; a comparable or upgraded category may be provided at our discretion when necessary.


Supplemental Service and Convenience Fees

If you request upgrades, additional stops, route changes, or customized services that require extra time or resources, additional fees may apply. Alternative payment arrangements (such as cash or wire transfer when supported) may incur a convenience fee reflecting additional handling and logistics. Any such fees will be disclosed to you before processing and require your agreement.


Third-Party Services and Partners

Payment platforms (Stripe, PayPal) and any analytics or support tools are operated by third parties under their own terms and privacy policies. We are not responsible for their acts or omissions. Where a transfer involves a third-party provider, our obligation is limited to the scope set out in your confirmation and these Terms; the third party may have additional conditions that apply.


Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy available on the Website. Payment data is processed by Stripe and PayPal; we do not store card details. By using our Website and Services, you consent to data processing as described in the Privacy Policy.


Communications and Official Channels

All confirmations, modifications, and cancellations must be made through the official channels listed on the Website or via email from an authorized @transfersshark.com domain. We are not responsible for communications sent to or from unofficial addresses or third-party messaging apps that are not expressly recognized on the Website.


Force Majeure and Events Beyond Our Control

We shall not be liable for any failure or delay in performance caused by force majeure events, including but not limited to extreme weather, natural disasters, pandemics, government orders, strikes, road closures, civil unrest, major traffic disruptions, or other circumstances beyond our reasonable control. In such cases, we may suspend, reschedule, or cancel the Service; we will make reasonable efforts to communicate promptly and propose alternatives where possible.


Liability and Disclaimers

To the maximum extent permitted by law:

  • We are not responsible for airline delays, missed flights, or decisions by airlines or authorities that prevent the Service from occurring as booked.

  • We are not liable for incidental, indirect, or consequential losses (including missed connections, additional accommodation, or alternative transport costs).

  • Our total liability in connection with any Service is limited to the amount paid for that Service.
    Nothing in these Terms limits liability for death or personal injury caused by gross negligence or willful misconduct where such limitation is prohibited by law.


Insurance

You are responsible for securing any travel insurance that suits your needs, including coverage for cancellations, delays, medical events, or lost property. Our insurance covers only those risks required by applicable law for operating transportation services.


Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Mexican States. Any dispute arising out of or relating to these Terms shall be submitted to the competent courts of the State of Quintana Roo, Mexico.


Language and Interpretation

If these Terms are translated into other languages, the English version shall prevail in case of discrepancies. Any ambiguity will not be construed against the drafting party; both parties acknowledge a fair and informed reading of these Terms.


Changes to These Terms

We may update these Terms from time to time. Changes are effective upon publication on TransfersShark.com. Your continued use of the Website or Services after changes are posted constitutes acceptance of the updated Terms. If a change materially affects an existing, fully paid reservation, we will apply the version in force at the time of booking unless the change benefits you.


Severability

If any provision of these Terms is held invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.


Waiver

No failure or delay by the Company to enforce any right or provision of these Terms constitutes a waiver of such right or provision unless expressly acknowledged in writing.


Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign or subcontract our rights and obligations as necessary to operate and deliver the Services.


Entire Agreement

These Terms, together with the booking confirmation, the Privacy Policy, and any written service-specific conditions provided at the time of purchase, constitute the entire agreement between you and the Company regarding the Services and supersede all prior understandings or communications on the subject.


Customer Acknowledgment

By completing your booking on TransfersShark.com, you acknowledge that you have read, understood, and agreed to:

  • these Terms and Conditions, and

  • the Cancellation, Refund, and Modification policies described above.

 

You further acknowledge that pricing, availability, vehicle allocation, and timing are subject to operational constraints, and that your responsibilities include providing accurate information, notifying us promptly of flight changes, and being present at the meeting point within the applicable time windows.
